PERM Labor Certification

PERM labor certification application is the first step for a foreign worker to obtain his or her green card with the following exceptions: 1) Employment-based first preference petitions, including EB-1B and EB-1A; and 2) Employment-based second preference national interest waiver (NIW).

PERM application is filed with U.S. Department of Labor (DOL) and once approved, an immigration petition can be subsequently  submitted to U.S. Citizenship and Immigration Services. 

Before a PERM application can be filed, an employer must follow complex and detailed procedures for advertising and recruiting a U.S. worker. The purpose is to test if there is a U.S. worker qualified, willing and available to take the position.  If not, the application may be filed and approved.  

PERM labor certification is a highly technical process. A mistake may forfeit all the prior efforts.  So a competent attorney’s guidance is strongly recommended.
